Virginia Attorney General's 7-0 Ruling Stuns Americans and Democrats

He added that the timing of the legal challenge aligns with Virginia’s legal history, noting that the General Assembly “blatantly ignored” constitutional requirements for amending the state constitution.

Cuccinelli also concurred with the lower court judge’s assessment that the ballot language was “flagrantly misleading.” He expressed confidence that the state Supreme Court would overturn the measure, likely in May, due to these fundamental procedural issues.

The former attorney general pointed out that supporters of the measure would need to win on four separate constitutional challenges to keep the map in place. He expressed doubt they could succeed, emphasizing that the process used to advance the referendum did not meet constitutional standards.

The case has garnered national attention because of its potential impact on the control of the U.S. House. Under the proposed map, Democrats would be strongly favored in 10 of Virginia’s 11 congressional districts. The legal battle is part of a broader national conflict over redistricting ahead of the midterm elections.

Democratic state Attorney General Jay Jones has indicated that the ruling will be appealed. Republican groups and sitting members of Congress who challenged the map have argued it would cause irreparable harm if implemented.
