U.S. Supreme Court Issues 7-2 Ruling in Closely Watched Case, Delivering a Victory for Veterans

The case centered on retired Army Captain James Rudisill, now an FBI agent, who served both before and after the 9/11 attacks and therefore qualified for benefits under two different versions of the GI Bill. The VA had wrongly told him that using the post-9/11 benefits meant forfeiting his pre-9/11 benefits — a decision that blocked his dream of attending Yale Divinity School to become a military chaplain.
The Supreme Court rejected the VA’s position, ruling that veterans who earned benefits under both programs are entitled to use them without unfair penalties. Navy veteran and veterans’ rights advocate Tommy Marquez called the decision transformative: “This could have a major positive effect on America’s veterans, our communities, and our nation for years to come.”
Marquez, who served in Naval Special Warfare and later used his own GI Bill benefits to transition into public service, emphasized that the ruling will impact around 1.7 million veterans who accumulated credits under both the Montgomery and Post-9/11 GI Bills. He described it as expanding horizons for nearly two million veterans, allowing them to combine their military experience with higher education, skilled training, or technical school to strengthen American communities and the economy.
