U.S. Supreme Court Issues 7-2 Ruling in Closely Watched Case, Benefiting Veterans

The case focused on retired Army Captain James Rudisill, currently an FBI agent, who served both before and after the 9/11 attacks, making him eligible for benefits under two different versions of the GI Bill. The VA had incorrectly informed him that using his post-9/11 benefits meant he would lose his pre-9/11 benefits—a decision that prevented him from pursuing his goal of attending Yale Divinity School to become a military chaplain.

The Supreme Court rejected the VA’s stance, ruling that veterans who earned benefits under both programs are entitled to use them without unfair penalties. Navy veteran and veterans’ rights advocate Tommy Marquez described the decision as transformative: “This could have a massive positive effect on America’s veterans, our communities, and our nation for years to come.”

Marquez, who served in Naval Special Warfare and later used his own GI Bill benefits to transition into public service, highlighted that the ruling will affect approximately 1.7 million veterans who accumulated credits under both the Montgomery and Post-9/11 GI Bills. He characterized it as expanding opportunities for nearly two million veterans, enabling them to combine their military experience with higher education, skilled training, or technical school to strengthen American communities and the economy.
