Barack Obama Expresses Alarm After Trump's Justice Department Affirms Broad Presidential Authority

Former President Barack Obama sharply criticized the Trump administration this week, accusing it of exerting political influence over the Department of Justice. In an interview with Stephen Colbert on CBS’ The Late Show, Obama expressed concern that the White House was directing federal prosecutions against political opponents, stating that the attorney general should serve as “the people’s lawyer,” not “the president’s consigliere.”
Obama suggested that Congress may eventually need to codify greater independence for the Justice Department to prevent the perception of politicized law enforcement. His comments come amid ongoing scrutiny of several high-profile federal investigations involving longtime critics of President Donald Trump, including former FBI Director James Comey.
The Trump administration responded forcefully. White House spokeswoman Abigail Jackson accused Obama of hypocrisy, pointing to declassified materials related to the origins of the Trump-Russia investigation during his presidency. Acting Attorney General Todd Blanche delivered the administration’s most detailed rebuttal during a Wednesday interview with CBS News in Phoenix.
Holding a pocket Constitution, Blanche emphasized Article II of the document, which vests executive power in the president. “It does not say that the Attorney General stands off to the side,” he stated. Blanche argued that presidents have broad authority to set law enforcement priorities on issues such as immigration, drugs, and national security. He maintained that the Justice Department is operating appropriately and that he begins each day with a “clean conscience.”
The dispute centers in part on the recent indictment of James Comey. Prosecutors alleged that a 2025 Instagram post featuring seashells arranged to form the numbers “86 47” constituted a threat against Trump, the 47th president. Investigators interpreted “86” as slang for “to eliminate.” Blanche defended pursuing such threats seriously, citing recent assassination attempts and rising political violence.
The exchange reflects deep partisan divisions over the proper role of the executive branch in directing federal law enforcement. Obama warned that allowing presidents to target political adversaries risks undermining public confidence in the justice system. The Trump administration countered that it is simply enforcing the law without political favoritism and highlighted the multiple criminal cases brought against Trump himself during and after his first term.
Blanche declined to detail any private conversations with President Trump but stressed that the president has “much better, bigger and important things to do” than micromanaging individual cases. He welcomed criticism but noted that those leveling accusations should examine their own records, referencing past investigations into Trump by state and federal authorities.
The public clash highlights ongoing debates about prosecutorial independence, executive authority, and the boundaries of political speech. Legal experts note that while presidents have historically influenced broad DOJ priorities, direct intervention in specific cases has long been controversial.
